Rules and Regulations

1. The Contest Period

a. The contest entry period commences February 22, 2017 and concludes at midnight PST on March 31, 2017.

b. Hosted by CanadianTraveller.com and subject to the following general rules and regulations.

2. Eligibility

a. The Contest is open to legal residents of Canada, excluding residents of the Province of Quebec, who, as at the start of the Contest Period, have reached the age of majority in their province or territory of residence. Employees of My Passion Media and members of their immediate families are not eligible to enter the Contest or win any prize.

3. How to participate

a. No purchase necessary.

b. During the Contest Period, visit CanadianTraveller.com/Contests/Canada150 and complete all mandatory fields of the online official entry form and click on “submit” for one (1) entry into the Contest. 

c. Failure to complete the form may result in disqualification to be determined in Contest Sponsor’s sole discretion. This is an online only contest; no other means of submission will be accepted.

d. Up to three (3) entries per person during the Contest Period are permitted. By submitting an entry, entrants agree to be bound by these official Contest Rules and any other applicable terms of use from the Contest Sponsors.

4. Winner Selection

a. On the week of April 3, 2017 a minimum of 5 and a maximum of 10 eligible entrants will be selected by a panel of judges, including Canadian Traveller magazine editor-in-chief Terrilyn Kunopaski, as the potential winners of the prizes, as described. Winners will be selected on the basis of: the photographer/writer’s ability to capture a truly Canadian moment; photo quality and appeal; and viability for publication. 

b. The potential winner will be contacted by an employee within five (5) business days of the draw by phone and/or email (the method selected at Contest Sponsor’s sole discretion), as provided by the entrant in his or her Contest entry form. The Contest Sponsors are not responsible for false, incorrect, changed, incomplete or illegible contact information. Notification is deemed to have occurred immediately upon sending of an email or placing a phone call.

c. The potential Prize winner has 3 business days after being contacted to reply.

d. The potential Prize winner if found to be ineligible, declines to accept the Prize or is unable to be contacted (including failing to return phone calls or emails) within five (5) business days of the draw may be required to forfeit the Prize and another eligible entrant may be selected at Contest Sponsors’ sole discretion.

5. The prizes

a. May not be exchanged for cash, currency, gift card or credit. 

b. Descriptions as follow: 

Have your photo/story featured in the summer issue of Canadian Traveller.  

Grand prize: Provided by Air Canada & Fairmont Hotels: Two round-trip tickets to anywhere in Canada, plus two nights at any Fairmont Hotel across the country.

Runner up prize (i): Provided by Samsonite: A set of Canadian Tourister luggage.

Runner up prize (ii): Provided by Manitobah Mukluks: A pair of men’s or women’s mukluks.

Runner up prize (iii): Provided by DK Canada: A prize pack including: the Eyewitness Canada Guide, Top 10 Montreal, Top 10 Toronto and Top 10 Vancouver.

6. Deadline for claiming the prize

a. Following confirmation as the Prize winner, in accordance with the Contest Rules, the selected entrant needs to fill in a form and return by either fax or email to confirm their shipping address. The potential Prize winner who fails either to inform the Contest Sponsors of his/her inability to claim the Prize before the deadline, as instructed, may be required to forfeit the Prize and another eligible entrant may be selected at Contest Sponsors’ sole discretion.

6a. Conditions for claiming the prize

The selected winner must correctly demonstrate completion of a skill-testing question in order to claim the prize.

7. Odds of winning

a. The odds of winning depend on the number of eligible Entries received during the Contest Period.

8. No Representations or Warranties

a. The prize winners understand and acknowledge that he or she will not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsors if the prize is in any way unsatisfactory to the winners.

9. LIMITATION OF LIABILITY AND DISCLAIMERS

a. BY ENTERING THE CONTEST, ENTRANTS AGREE TO BE BOUND BY OFFICIAL RULES, AND AGREE TO RELEASE MY PASSION MEDIA, EACH OF THEIR EMPLOYEES, AGENTS AND REPRESENTATIVES, SUBSIDIARIES, AFFILIATED COMPANIES, CONTROLLED CORPORATIONS, ADVERTISING OR PROMOTION AGENCIES, SPONSORS, SUPPLIERS OF MATERIALS, PRIZES AND SERVICES RELATED TO THE CONTEST, OR ANY OTHER PERSON DIRECTLY ASSOCIATED WITH THE HOLDING OF THE CONTEST (“RELEASED PARTIES”) FROM ANY AND ALL LIABILITY WHATSOEVER, FOR LOSSES OR DAMAGES OF ANY KIND THAT RESULT FROM ACCEPTANCE, POSSESSION OR USE OF ANY PRIZE OR FROM THE ENTRY OR THE ATTEMPTED ENTRY IN THE CONTEST. THE RELEASED PARTIES ASSUME NO LIABILITY FOR LOST OR MISDIRECTED ENTRIES, WHETHER DUE TO TECHNICAL OR COMPUTER MALFUNCTIONS OR OTHERWISE OR ANY OTHER TECHNICAL OR COMPUTER MALFUNCTIONS, FRAUD, OR OTHER ERRORS.

b. MY PASSION MEDIA RESERVES THE RIGHT, IN ITS SOLE DISCRETION TO CANCEL, TERMINATE OR SUSPEND THE CONTEST IN ITS ENTIRETY, IN THE EVENT THAT THE WEBSITE IS INFECTED BY A VIRUS, A SOFTWARE BUG, THE WEBSITE IS HACKED, UNAUTHORIZED HUMAN INTERVENTION OCCURS OR THE INTEGRITY, ADMINISTRATION, IMPARTIALITY OR NORMAL OPERATION OF THE CONTEST IS COMPROMISED IN ANY WAY WHATSOEVER.

c. NONE OF YOUR PERSONAL INFORMATION WILL EVER BE SHARED, RENTED, SOLD OR OTHERWISE RELEASED TO ANY THIRD PARTY BY MY PASSION MEDIA. 
THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, FACEBOOK. THE CONTEST HOST HEREBY RELEASES FACEBOOK OF ANY LIABILITY.

10. GENERAL

a. Entrants, by entering the Contest, agree to abide by the Official Rules, and agree that the decisions of My Passion Media are final and without appeal with respect to all aspects of the Contest including, without limitation, the eligibility and/or the disqualification of Entries.

b. All Entries are subject to audit by of My Passion Media. Any Entry that is incomplete, fraudulent, copied, received late, discriminatory, defamatory, offensive, obscene, vulgar or against good morals or prejudicial to My Passion Media, its subsidiaries, affiliated companies, parent corporations, its employees, agents, representatives, directors and officers, its advertising and promotion agencies or any other person related in any manner whatsoever to My Passion Media will automatically be rejected and will not be eligible for the Prize.

c. My Passion Media is not responsible for any changes or effects caused by or to the Entrant’s computer system as a result of submitting electronic Entries.

d. All Entries are the property of My Passion Media. No responsibility will be taken for Entries lost, delayed, incomplete, damaged, stolen, undelivered or misdirected, all of which are void, or that cannot be processed due to phone, network, electronic, or computer hardware or software failure, or technical failures of any kind.

e. By entering this Contest, Entrants agree to release, discharge and hold harmless the Released Parties from any and all liability for any injury, loss or damage of any kind to persons, including death, and property, whether direct or indirect, which may be due or arise out of participation in the Contest or any portion thereof, or the acceptance, use/misuse or possession of prizes, or any prize-related travel or activity.

f. Any prize is non-exchangeable, non-transferable, non-refundable, has no cash-surrender value, and must be accepted as awarded with no substitutions. My Passion Media reserves the right, in their sole discretion, to substitute and/or modify any prize with (a) prize(s) of equal or greater value for any reason.

g. Subject to applicable law My Passion Media reserves the right to terminate or withdraw this Contest at any time, for any reason whatsoever.

h. This Contest is subject to all federal, provincial and municipal laws and regulation.

i. If any provision in the Official Rules herein is found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void however all other provisions herein shall remain valid and enforceable to the full extent permitted by law.

j. My Passion Media reserves the right to publish winning entries on CanadianTraveller.com, with story and photo credit attributed to the Entrant.  

11. PERSONAL INFORMATION

a. When entering the Contest, the Entrant agrees that his or her personal information collected by My Passion Media shall be used in accordance with applicable law in order for My Passion Media or its agents to contact the Entrants for the purposes of the Contest. In compliance with the Personal Data Protection Legislation in force, Entrants expressly consent the incorporation of their Personal Information into My Passion Media database and its treatment for the purposes hereof. My Passion Media has adopted the technical and organizational measures necessary to ensure the security of Personal Information and to prevent their alteration, loss, unauthorized processing or access. At any time you may revoke your consent and exercise your rights of objection, access, rectification and cancellation by addressing our Compliance Officer.

b. Featured stories and photos will credit the name given in the submission form. FIRST NAME, LAST NAME. We will not resell your story or use submitted images for any other purpose than those outlined in the contest. 

c. You may obtain any information about the Contest such as the name of the Winner, or raise complaints with jenniferh@mypassionmedia.com.

d. Provision of personal data to My Passion Media: If an Entrant types 'yes' in the applicable box on the entry form for this Contest, the entrant agrees to receive electronic messages from My Passion Media containing e-newsletters and offers with respect to products and services that may be of interest to them, including notification of sales, special events and recently published content. Such Entrants may withdraw their consent at any time by selecting the unsubscribe option within such electronic messages.
